    为促进两岸经贸交流与发展，海峡两岸关系协会与财团法人海峡交流基金会依据《海峡两岸经济合作框架协议》（以下简称ＥＣＦＡ）第六条有关规定，就两岸海关合作事宜，经平等协商，达成协议如下：

    第一条 定义

    海关程序指双方海关及行政相对人应遵守的相关程序及规定；

    海关合作指双方为执行海关规定而进行的各项合作；

    第二条 范围

    本协议适用于执行海关程序及进行海关合作的相关事宜。

    一、促进双方海关程序的简化及协调，提高通关效率，便利ＥＣＦＡ的执行。

    第四条 便利化

    一、双方应确保海关程序及其执行具有可确定性、一致性及透明性，其海关估价、商品归类等规定应与世界贸易组织或世界海关组织有关规定相一致。

    第七条 行政救济

    第八条 合作内容

    双方海关在包括但不限于以下领域内进行合作：

    一、相互通报有关海关规定；及时交换与ＥＣＦＡ货物贸易有关的海关估价、商品归类及原产地确定所需的证件、文书等相关资料。

    二、为正确计征ＥＣＦＡ货物贸易进口货物关税，主动或应请求提供及核查海关估价、商品归类及原产地确定有关信息。

    三、进行查处走私相关合作与技术交流，主动或应请求提供查处走私及其他违反海关规定行为的情报资料与协助。

    四、对通关过程中产生的问题应及时进行沟通协调，采取必要措施予以解决。

    第九条 请求的方式

    请求方海关应以书面方式提出请求，并附所需文件。如情况紧急，请求方海关可提出口头请求，但应尽速以书面方式加以确认。

    第十条 请求的内容

    一、依据本协议所提出的请求应包括下列内容：

    （五）涉及有关规定的说明；

    （六）答复时限及联络方式；

    （six）Reply to time limit and contact way；

    （七）其他经双方海关同意应说明的事项。

    二、被请求方海关必要时可要求请求方海关对上述请求进行更正或补充。

    第十一条 请求的执行

    一、被请求方海关应在其权限及能力范围内采取合理的执行措施。

    二、被请求方海关可依请求提供经过适当认证的文件资料及其他物件。除被特别要求书面文件外，被请求方海关可传送电子信息并提供必要的说明。

    一、双方同意，由两岸经济合作委员会海关合作工作小组负责处理本协议及海关合作相关事宜，由双方海关各自指定的联络人负责联络，并建立联络热线，以保障协议的顺利实施。必要时，经双方同意，可指定其他单位负责联络特定事项。

    第十三条 保密义务

    一、依据本协议所取得的任何信息，应受到在接受方取得同类信息所应受到相同程度的保护。

    二、一方海关对所提供信息的保密性有特殊要求并说明理由，另一方海关应给予特殊保护。

    三、如未事先获得被请求方海关的书面同意，请求方海关不得将取得的信息转交其他单位及人员，亦不得在司法及行政程序中作为证据使用。

    第十四条 费用

    一、双方海关就执行请求所产生的一切费用，原则上应放弃获得补偿的要求。如执行请求需要支付巨额或特别性质的费用，双方海关应商定执行该项请求的条件及有关费用负担的办法。

    第十五条 文书格式

    本协议修正，应经双方协商同意，并以书面形式确认。

    第十七条 生效

    本协议签署后，双方应各自完成有关程序并以书面通知另一方。本协议自双方均收到对方通知后次日起生效。
