　　本办法所称城市道路摊区(以下简称摊区)是指临时占用城市道路经营农副产品、日用工业品和其他生活消费品的摊位市场。提倡和鼓励企业和个人设置室内市场，吸纳摊区业户进入室内经营，推进摊区退路进厅。

　　在限制区域方面，征求意见稿规定：城市一类街路；繁华商业地区；旅游景区；学校、医院周边的街路；公共汽车、电车通行的街路和长途汽车客运站周边的街路不得设置摊区。城市二类街路应严格控制设置摊区；已经设置的，应有计划地退出。未经批准，任何单位和个人不得占用城市道路设置摊区。街道办事处应当在摊区设置明显界标，摊位不得占用绿地和居民住宅小区的出入口。摊区业户不得在划定的摊区范围外经营。摊区内不得设置固定经营设施。

　　征求意见稿规定，摊区的开闭时间应根据地理位置和交通流量由街道办事处确定，但早市最迟不得超过八时三十分闭市，夜市最早不得在十六时三十分之前开市。摊区开闭市时间应当在摊区出入口公示。

　　摊区业户应当遵守下列规定：按照划定的摊位和规定时间出摊、收摊；销售的商品质量符合国家规定标准；遵守有关治安、消防、食品卫生、计量、动物产品检疫管理等规定；保持摊位和周边环境整洁；按规定缴纳占道费、生活垃圾处理费；不得损坏环境卫生和园林绿化等设施。

　　在收费管理方面，街道办事处应当按照规定的标准收取生活垃圾处理费。街道办事处不得将摊区管理职责委托其他组织或者个人实施。城市管理部门可以委托街道办事处按照规定的标准收取占道费，并上缴区财政部门，摊区的管理费用由区财政部门核拨。残疾人和享受最低生活保障人员在摊区内从事经营的，免收占道费和生活垃圾处理费。街道办事处发现业户有违法行为的，应当及时向有关行政部门报告。有关行政部门和街道办事处及其工作人员，对摊区业户勒拿卡要，或者打骂摊区业户的，或者向摊区业户乱收费、乱摊派、乱罚款的，将根据有关规定予以行政问责。
