　　常开余律师告诉记者，小方和旅行公司，应该是一次性的劳务关系，在这种条件下，公司要处罚小方，要拿出符合法律程序的证据。虽然第一笔罚款是潜规则，但是对方拿出证据，小方也承认自己有过失，所以让他全额支付。但是第二笔3000元罚金，到底是谁的责任目前尚未搞清楚，没有确凿证据，这笔钱不可能获得支持。常律师还强调，行业“潜规则”是拿不上台面的，更不能用这个规则惩罚劳动者，不然肯定是不合理的。
