本报讯(记者张蕾) 齐女士参加肯尼亚10日游回来后，因当地地接导游不是她所要求的“会说中文的当地人”而将旅行社告上法庭，要求全额退款。齐女士说，地接导游就是一名普通的中国人，她想了解当地的民俗文化，对方一概不知。上午，此案在朝阳法院开庭。如何理解“当地人”的概念，成为庭审争论的焦点。

　　齐女士起诉称，今年7月23日，她与北京中国国际旅行社有限公司签订了出境旅游合同，约定于今年8月13日参加旅行社组织的肯尼亚深度十日游。齐女士主张，双方约定提供的旅游服务内容包括讲中文的肯尼亚当地黑人导游，并将此写进了合同条款。

　　齐女士说，今年8月13日登机前，得到旅行社工作人员的再次承诺后，她按照要求先行缴纳了司机、导游小费100美金。但到达肯尼亚后，旅行社提供的导游却是当地的华人导游，导致她想了解当地的民风民俗、社会福利、生活水平、国家发展史、政体结构、人民文化和生活喜好、社会保障等，导游一概不知。

　　为此，齐女士向法庭出具了随团其他游客的书面证言，证明全团安排的是华人导游，非“黑人”导游。齐女士认为旅行社的行为构成欺诈，因此诉至法院，要求退还15700元旅游费用及100美金小费。

　　法官询问齐女士一定要找当地导游的原因。齐女士说：“我去一个国家，就是希望了解当地的民俗和人文文化，但我外语又不太好。而且我有一个习惯，每次出国都会留下当地导游的QQ号或联系方式，回国后会进一步联系了解当地的民俗。我在签合同时把我的意思说得很清楚。正因为我以前出国旅游遇到过类似的事情，所以我才强烈要求将此条款写入合同中。”
