本报讯 因参加肯尼亚十日游,地接导游是中国人，而并非合同约定的“当地人会说中文话的”，齐女士将北京中国国际旅行社有限公司（以下简称国旅）诉至法院,要求退赔全额团费及小费。

　　今日上午,朝阳法院作出一审判决，认定旅行社合同履行存在瑕疵，部分支持了齐女士的诉请，判令旅行社退还团费5000元。

　　齐女士诉称，旅行社承诺为其提供当地黑人导游，对此，在签订合同时，她特意要求在第七条“其他约定”中注明：“当地地接导游为当地人会说中文话的黑人”，而到肯尼亚当地后旅行社提供的是黄皮肤的华人导游，认为旅行社未履行承诺的旅游服务，故诉至法院。

　　齐女士与旅行社就“当地人”的理解展开激烈的辩论。齐女士认为，当地人应为当地黑人，即使不是黑人，也应当在当地有生活经验，能满足其对当地国情、风土人情、人民生活情况有所了解的需求。

　　法庭认为本案中，双方在旅游合同中专门在“其他约定”一条就地接导游身份添加了手写的约定，说明当事人在协商签订旅游合同的过程中，对地接导游身份情况有特别要求的意思表示，因此，仅仅是会说中文，具有居住权，并不是当事人此条特别约定的完整意思表示，应就“当地人会说中文话的”做完整的、符合一般人普遍认知的、符合合同签订背景的理解。
