本报讯（记者张剑）因参加肯尼亚十日游，地接导游是中国人，而并非合同约定的“当地人会说中国话的”，游客齐女士将北京中国国际旅行社有限公司（以下简称国旅）诉至朝阳法院，要求退赔全额团费及小费。记者昨日从朝阳法院获悉，法院作出一审判决，认定旅行社合同履行存在瑕疵，部分支持了齐女士的诉请，判令旅行社退还团费5000元。

　　2012年7月23日，齐女士与国旅签订了旅游合同，约定参加该旅行社组织的肯尼亚深度十日游，团费15700元/人，司机小费100美金。齐女士支付了上述费用，2012年8月13日，齐女士如约出行。

　　齐女士称，旅行社承诺为她提供当地黑人导游。在签订合同时，她特意要求在第七条“其他约定”中注明：“当地地接导游为当地人会说中国话的黑人。”而到肯尼亚当地后，旅行社提供的是黄皮肤的华人导游，该导游对当地的民风民俗、社会状况等一概不知。

　　齐女士表示，她去一个国家非常希望了解那里的民俗文化和风土人情，这也是她特别在合同里提出要当地导游的原因。齐女士认为旅行社未履行承诺，故诉至法院，要求旅行社全额退还团费及小费。

　　庭审中，国旅辩称，合同约定的是提供会说中国话的导游，并未约定是黑人。该社安排的地接导游虽为华人，但其已取得肯尼亚居住权和导游资质。该旅行社已完全履行合同约定，不存在违约，故不同意齐女士的诉讼请求。

　　法院审理查明，签订合同时双方确实对当地地接导游进行过特别约定，并以手写方式在合同“其他约定”中予以明确，但是双方持有的合同文本中手写内容不一致，齐女士持有的合同中注明地接导游为“当地人且会说中文的黑人”，国旅持有的合同中则为“当地人会说中国话的”，并无“黑人”二字。国旅认为，齐女士合同中的“黑人”二字为后加。

　　经审理法院认为，双方持有的合同不一致，两份合同均有双方签字盖章，齐女士不能解释合同不一致的原因，故仅采信双方合同中一致的部分，即认定地接导游约定为“当地人且会说中文的”。因此，可以认定旅行社对旅游合同的履行存在瑕疵。根据旅行社的过错程度，法院最终判令旅行社返还齐女士团费5000元。
