今年1月6日，市民周先生在市区某旅行社签订了10人的“斯里兰卡六天游”旅游合同，准备春节期间与家人一同出境旅游，当天周先生就交付全部团款106990元。但签订合同不久后，周先生的侄女不慎摔伤，无法按照原定计划出发，为此周先生一家决定退团取消旅程。1月21日，距离出团还有22天，周先生以书面形式致函该旅行社及其广州总部，要求退团，可得到的回复是，需扣除90%团款，只能退回10%。

　　“赔偿旅行社的损失可以理解，可为何要赔这么多？”周先生对此深感不解。回想报名之初，该旅行社曾提供三份合同让周先生签名。第一份是《广东省出境旅游组团合同》，其中规定甲方若因自身原因在出发前14天或以上退团，应按乙方实际的业务损失承担违约责任，并按旅游费用的5%支付违约金；第二份是《出国旅游报名表及补充约定》，其中规定甲方在出发前14天或以上退团，按旅游费用的20%赔偿对方经济损失；第三份则是标明春节期间包括斯里兰卡在内的部分线路，甲方在出发前7天或以上退团，需赔偿90%的团费。

　　提前22天退团，仍需赔偿90%的团款是否合理？随后，市旅游局质监所旅游执法监察大队进行调解，并认为该合同违约责任应当适用第一份及第二份合同的规定，而不能适用第三份合同。可惜的是，经过调解后,周先生与旅行社仍未能就赔偿问题达成一致协议。日前，周先生决定从法律途径进行维权。
