　　郑先生在投诉时表示，遭遇到了旅行社的欺诈行为，对此记者咨询了辽宁申扬律师事务所梁新春律师。“所谓欺诈，是指一方当事人故意告知对方虚假情况，或者故意隐瞒真实情况，诱使对方当事人作出错误判断的，可以认定为欺诈行为。就目前的情况看如果郑先生一家仅仅是因旅游巴士迟到，严格讲是不构成欺诈的，应该就是违约。”梁律师表示，“至于旅行社在购物、行程上的安排是否构成欺诈，那就要看郑先生一家与组团社签订合同的具体要求了。”“合同约定了安排的景点，结果没去;到旅行社指定的并承诺不会有问题的商场购物买到了假货或者高价货;说好三星宾馆结果住到了小旅店;被转包到其他旅行社而没有告知游客等等这些都有可能构成欺诈。”梁律师提醒：旅游合同是最重要的：“在合同中将行程等重要信息进行确认，包括旅行社的各种承诺都要形成文字;同时约定违约罚则。因为违约行为对于游客的损失往往难以认定，所以最好提前约定好赔偿。一旦遭遇欺诈，至少可以获得双倍赔偿。”
