一酒店竟把小年变成了国家法定节假日，不让顾客使用代金券抵现金。

　　日前，消费者汪女士到汉阳鹦鹉大道马鹦路的一家酒店进餐，获得2张50元的代金券。2月4日，用代金券抵消费时，店家却说，代金券写有：法定节假日不能使用。汪女士认为，中国有过小年风俗，但小年并不是法定节假日。可店家却说，解释权归商家所有。汉阳鹦鹉工商所人员核实投诉后，认为酒店无权将小年定为法定假日；“解释权属于商家”是无效的霸王条款。后经调解，酒店昨天退还了消费者的100元现金。
