　　男子小新（化名）参加公司组织的旅行活动，但在旅行途中遭遇意外，旅行大巴和一轿车相撞，导致小新当场身亡。事后虽然法院判决旅行大巴所在公司及轿车司机分别赔偿小新的父母各33万余元，但小新父母始终没有拿到小新的死亡赔偿金。无奈之下，小新父母将当时参加旅行所报团的市某旅行社告上法庭，索赔97万余元。一审法院驳回了小新父母的诉讼请求，此案昨天在市中院二审开庭。

　　事故发生后，客家公司向徐先生夫妇支付了4万元，惠州市博罗县人民法院院判决客家公司和邓先生分别赔偿徐先生夫妇33万余元，黄先生对邓先生的赔偿义务承担连带责任；客家公司、邓先生、黄先生互负连带赔偿责任。
