昨天，市一中院驳回了精神病患者宋某某强制医疗复议申请案，维持了一审决定。这是新刑诉法实施以来，本市审结的第一例强制医疗复议申请案。

　　2012年11月30日16时许，精神病患者宋某某在地铁2号线鼓楼大街站，将在站台候车的李某推下站台，致李某被进站列车碾轧受伤，造成多处骨折等。公安机关在抓获宋某某后，发现其有精神病史并存在精神病症状，于是对其进行鉴定。今年1月6日，宋某某被鉴定为无刑事责任能力，依法不负刑事责任，被公安机关采取了临时保护性约束措施。之后，检察院向法院提出对宋某某强制医疗的申请。

　　据了解，宋某某有多年的精神病史，被诊断患有精神分裂症后曾在多家医院接受治疗，但病情一直未能有所好转，案发前曾多次发生暴力性伤人毁物行为。海淀法院一审认为，宋某某的行为符合强制医疗的条件，于今年3月17日作出对宋某某强制医疗的决定。由于宋某某的母亲爱子心切，希望留儿子在身边照顾，于是向一中院申请复议，希望法院解除对宋某某的强制医疗决定。

　　负责此案的一中院法官周维平介绍，在宋某某的母亲提出申请后，法院了解了宋某某之前的相关情况，发现宋某某在推人下地铁之前，也多次发生危害他人的暴力行为，比如在小区里无端用脚踹汽车，听到旁边有人咳嗽就觉得对方要伤害自己于是实施报复行为等等。因其之前的行为没达到犯罪程度，最终均民事赔偿解决。

　　周维平告诉记者，他曾到宋某某接受强制医疗的安康医院看望，宋某某当时处于思维清晰状态，并告诉法官自己过得挺好，生活很有规律，希望持续治疗，好转后能重新回归社会。“此时他对之前的行为认识非常清晰，知道违法，但自己控制不住，对被害人感到非常抱歉。”周维平说，宋某某的家人已经在案发后与被害人达成民事赔偿协议，并已经完成赔偿。治疗宋某某的医生告诉周维平，宋某某的治疗情况在逐渐好转，精神病症状已经有所缓解，但精神病的治疗是一个长期、持续的过程。
