　　认为女儿的死亡是医院过错导致，刘先生夫妇将某妇婴医院告上法庭。记者今天获悉，北京二中院终审驳回双方上诉，维持一审法院作出妇婴医院赔偿刘先生夫妇检查费、医疗费、婴儿用品费及精神抚慰金共计21万余元的判决。

　　2010年9月，刘先生夫妇起诉至一审法院称，因妇婴医院的超声检查有误导致先天性心脏病婴儿的出生进而死亡，医院应承担全部民事赔偿责任，要求赔偿120余万。妇婴医院辩称，医院的诊疗行为没有过错，婴儿的死亡与医院的诊疗行为没有因果关系。医院并非产前检查医院，而且即便是产前诊断医院对于严重心脏病异常的诊断率也仅为40%。此外，仅凭一次检查也不可能查出心脏畸形，需要多次进行检查复诊才可以看出。而且刘先生夫妇的诉讼请求已过诉讼时效。

　　通过司法过错鉴定，鉴定中心鉴定意见认为，妇婴医院在对诊疗过程中存在超声心动图检查错误诊断，未考虑超声心动图的误诊、漏诊率，未告知复查、随诊，妇婴医院的医疗过错行为使刘先生妻子丧失了选择权；妇婴医院的医疗过错行为与刘先生之女死亡结果之间无因果关系。一审法院经审理判决后，刘先生夫妇及妇婴医院均不服，分别上诉至二中院。

　　二中院经审理认为，根据司法鉴定意见，妇婴医院理应给予刘先生夫妇足额的经济赔偿及适当的精神抚慰金。一审法院判决妇婴医院全额赔偿刘先生夫妇检查费、女儿的医疗费以及婴儿用品费并无不当，酌定的精神抚慰金数额亦与案件的具体情况相适应。妇婴医院提出的时效抗辩不能成立。但刘先生夫妇主张的新生儿死亡赔偿金及丧葬费，因全心功能衰竭死亡与妇婴医院的诊疗行为之间并不存在因果关系，不予支持。(通讯员 张璐)
