　　浙江省高级人民法院、省人民检察院和省公安厅今天联合公布了《关于办理危害食品药品安全犯罪案件适用法律问题的会议纪要》，同时发布了危害食品、药品安全犯罪10大典型案例。

　　纪要共16条，明确界定了“地沟油”和“问题胶囊”犯罪。“地沟油”犯罪是指用餐厨垃圾、废弃油脂、各类肉及肉制品加工废弃物等非食品原料，生产、加工食用油，以及明知是利用“地沟油”生产、加工的油脂而作为食用油销售的行为。利用“地沟油”生产、加工食用油，或者明知是利用“地沟油”生产、加工的油脂而作为食用油销售的，依照刑法第144条生产、销售有毒、有害食品罪的规定追究刑事责任。明知系利用“地沟油”生产、加工的食用油，掺入合格食用油后作为食用油销售的，以生产、销售有毒、有害食品罪追究刑事责任。而利用工业明胶生产食品或直接入口的食品、药品辅料，或者明知系利用工业明胶生产的食品或直接入口的食品、药品辅料而予以销售的，以生产、销售有毒、有害食品罪追究刑事责任。

　　为依法严惩危害食品药品安全犯罪，纪要专门规定，对于此类案件一般不适用缓刑或免刑。犯罪情节较轻，或具有自首、立功等法定从轻、减轻处罚情节，或系从犯，依法适用缓刑的，一般同时宣告禁止令，禁止被告人在缓刑考验期内从事与食品、药品生产、销售等有关的活动。在对被告人依法适用主刑的同时，处以销售金额1倍以上5倍以下的罚金，加大没收财产刑的适用与执行力度，从经济上剥夺犯罪分子再次犯罪的能力和条件。
