记者近日从平谷法院获悉，因腹部胀痛，现年36岁的张女士到平谷一中医医院就诊，但前后六次看病医院均未查出怀孕，最终导致其将7个半月的胎儿人工引产。为此张女士将医院诉至法院，索赔2.7万余元，经调解最终张女士获赔7000元。

　　张女士表示，去年12月15日，她因腹部胀痛、闭经4个月到医院就诊，一医生先后两次诊断，未查出怀孕，只给开了15服草药。服药后病情不见好转，张女士又找该医生，诊断为血瘀、腰疼，并先后四次开了28服草药。今年3月11日晚，张女士腹部剧痛到平谷区医院急诊，经查已怀孕7个半月，后做了人工引产。张女士认为，职业医生通过号脉便可知道就诊者是否怀孕，且她就诊时已闭经4个月，当事医生的行为属于误诊，这给她带来人身痛苦和精神创伤，索赔各项损失共计2.7万余元。

　　医院代理人则称，去年12月15日至今年2月10日期间，医务人员按中医诊疗常规对张女士检查后，诊断为“闭经四月、寒湿、血瘀、腹痛”等，用药汤剂调治。对于未能查出张女士怀孕一事，代理人说，中医诊疗与西医诊疗存在根本性的不同，不能以西医的检查结果认定中医诊疗存在过错。此外代理人还表示，张女士提交的病历表明，引产时其分娩出一活胎，该胎儿是否存在畸形、目前状态等均不清楚，因此不能证明中医开出的药剂对张女士有损害。且张女士是意外怀孕，引产未对其造成伤害，医院不应承担侵权赔偿责任。
