3月底,徐女士向宝山法院起诉,认为开发商在售房时,拿出来的该房型房屋销售宣传资料以及该房型样板房中,南面卧室窗户和外墙面均是平行的,窗户均未向内凹进,都有 “飘窗”。飘窗的面积虽然不计入房屋建筑面积,但是其他楼层都有这个附赠的面积,所以要求参照房屋的实际单价计算损失。鉴于南面卧室窗户朝内凹进0.75米,窗户的宽度为1.75米,所以减少的飘窗面积为1.3125平方米,再乘以系争房屋每平方米16966.41元的单价,总价是22000多元,再考虑到采光视野受限,整个房屋的格局有影响,所以用3万元计算损失。

庭审中被告开发商辩称,预售合同附件只是标示了系争房屋的基本位置,不能看出具体窗户的问题。签约时,销售人员告知过原告该是顶层,不是标准层,样板房是根据2至11楼的标准层来设计的。原告购房时知道顶层比10楼、11楼的单价优惠很多,10楼、11楼的单价是18300元,系争房屋的单价不到17000元。

同时认为,预售合同补充条款约定,样板房及售楼资料仅供参考,系争房屋情况应当以预售合同为准。交房时,原告验收了房屋且签收了房屋验收表,原告当时对南面卧室窗户也未提出异议。系争房屋南面卧室窗户凹进去的部分是不计算建筑面积的,故建筑面积并未因此减少,不同意原告的诉讼请求。

法庭经过调查得知,该房屋南面卧室窗户和外墙是在一个平面上,而墙的外立面向外凸出,与空调架在一个平面上,由此显得窗户向内凹进,即没有“飘窗”。而该建筑的2至11楼南面卧室窗户和外墙不在一个平面上,与空调架却在一个平面上,由此显得有“飘窗”。

法院认为,合同附件及平面图是标示墙体中心线的单线图,并未标示南面卧室窗户的具体位置,仅确认系争房屋建筑面积为88.41平方米,且根据《房屋交接书》,系争房屋的实测建筑面积为88.23平方米,两者相差0.18平方米,双方又以该实测建筑面积为依据结算了房款。鉴于被告交付的系争房屋建筑面积经过原、被告双方认可,且上述合同中又未约定被告赠送原告不计入建筑面积的南面卧室“飘窗”,故原告的相关主张缺乏依据。

原告主张系争房屋南面卧室窗体状况与房屋销售宣传资料不符、与购房时被告展示的该房型实物样板房不符,但根据双方签订的《预售合同》补充条款第3条的约定,被告所购房屋面积、结构、装修设备标准均以合同及其附件为准,样板房及其样板区域以及售楼资料仅供展示、参考,故对原告以此主张被告违约亦不予支持。
