国际海事委员会第40届大会10月15日在北京举行。船舶司法出售国际承认公约草案将力争在会上获得通过，定名为北京规则。

　　据介绍，此次会议的主要议题包括通过船舶司法出售国际承认公约草案，修订国际救助公约、约克—安特卫普规则等，同时还涉及扣船公约、跨境破产、南北极法律问题、海商法钻井平台、鹿特丹规则、海事仲裁、海上保险、船员问题、海盗等相关前沿议题。

　　我国是法院扣押和拍卖船舶数量较大的国家。2008年，国际海事委员会正式成立了船舶司法出售问题的国际工作组，由中国海商法协会副主席李海担任组长。中国海商法协会专门成立了工作组研究这一议题，以争取对我国最有利的公约条款。船舶司法出售国际承认公约草案如能在此次大会上获通过并被广泛接受，将会在很大程度上统一缔约国在这方面的法律规则，这将促使我国法院扣押进而出售船舶的效力获得广泛的国际认可。

　　近年来，关于修订《1989年救助公约》的呼声开始日渐高涨，原因在于该公约在财产救助与环境救助关系的处理方面，仍然以财产救助为中心，将环境救助置于从属地位，不能满足日益迫切的海洋环境保护需要，同时也暴露环境救助适用地域范围过窄等问题。我国支持并积极参与该公约修订，并在公约修订中充分表达独立意志。

　　据悉，国际海事委员会是促进海商法统一的非政府间国际组织，国际海事委员会大会每四年举办一次，由来自世界各国或地区的海商法协会代表以及相关国际组织的代表出席。本届会议是该委员会成立115年来首次在中国举办。来自48个国家和地区的海商法协会负责人、法官、学者、律师、工商界代表和12个国际组织的代表约400人出席了本届大会。
