本报讯（通讯员刘杨田 蒋巍）在大学谈了4年的恋爱，小陈却在与女友分手后，持借条向女友追债。近日市一中院做出终审判决，部分支持了小陈的诉讼请求，判决对方返还小陈欠款共计22000元。

　　市一中院终审认为，借条作为书证具有较强的证明效力。小苏虽然否认借贷关系成立，主张借条系自己受胁迫所写，但是未能就此提出证据予以证明，故应承担举证不能的责任。综合全案证据，小陈提交的证据能够反映出双方当事人就借款事宜达成了一致，并产生了借贷事实，小陈依法对小苏享有债权，小苏应当及时返还欠款。鉴于借条中并未约定利息，小陈主张5000元的利息没有依据，故依法驳回小陈的该点诉讼请求。
