  用人单位如果不对从事接触职业病危害的农民工进行职业健康检查的,将由县级以上人民政府安全生产监督管理部门责令限期改正,给予警告,可以并处五万元以上十万元以下罚款。这是记者从昨天举行的省十一届人大常委会第三十三次会议上了解到的。

  《条例(草案)》还对农民工就业培训专项资金和农民工工资保证金的管理、农民工工伤权益的保障等方面作进一步补充完善。据此,《条例(草案)》修改为,用人单位不得与农民工约定减轻或免除其对农民工因工伤亡或者患职业病应当承担的法定责任。约定减轻或者免除责任的,约定无效。用人单位未向农民工提供符合国家标准或者行业标准的劳动防护用品和劳动防护措施的,由县级以上人民政府安全生产监督管理部门责令限期改正;逾期不改正的,责令停产停业整顿,可以并处五万元以下罚款。用人单位如果不对从事接触职业病危害的农民工进行职业健康检查的,将由县级以上人民政府安全生产监督管理部门责令限期改正,给予警告,可以并处五万元以上十万元以下罚款。《条例(草案)》同时规定,从事特种作业工种的农民工应当按照国家有关规定经专门的安全作业培训,取得特种作业操作资格证书,方可上岗作业。用人单位对从事接触职业病危害作业的农民工,应当组织上岗前、在岗期间和离岗时的职业健康检查,将检查结果如实告知农民工,并建立健康监护档案,按照规定期限妥善保管。农民工离岗时,有权索取本人职业健康监护档案复印材料,用人单位应当如实无偿提供加盖单位印章的复印件。未进行离岗职业健康体检的,用人单位不得解除劳动合同。职业健康检查费用由用人单位承担。(燕赵都市报记者刘彬 实习生秦秋朵)
