据中国之声《央广新闻》报道，《江西省遗体捐献条例》近日经江西省人大审议正式通过，将于2013年3月1日起施行。条例规定自然人生前表示不同意捐献遗体的，任何组织或个人不得违背其生前意愿；擅自接受遗体、器官的，最高可处以三十万元的罚款等内容。

　　2010年3月，中国红十字总会和卫生部开展人体器官捐献试点工作，江西被列为首批10个试点省市之一。可以说，随着社会的不断进步，遗体器官捐献对于促进医学科学事业发展、保障人的生命健康、促进移风易俗越来越有重要的意义。但是，根据一份2009年的统计数据，美国器官移植的等待者和捐献者之间的比例为5∶1，英国为3∶1，而我国的比例为150∶1。此外，以江西省为例，目前全省医学院校平均60名学生才有一具遗体供教学使用，远不能满足正常教学和科研需要。所以只有通过立法，才能解决捐献纠纷发生，杜绝地下买卖行为，遏制违法犯罪行为。同时为有效增加遗体器官来源、缓解供体短缺提供有力的法制保障。

　　《条例》首先明确了遗体和器官捐献是一项崇高的社会公益性事业，公民享有捐献或者不捐献其遗体和器官的权利。任何组织或者个人不得强迫、禁止以任何形式买卖遗体和器官，以及从事与买卖遗体和器官有关的活动。

　　《条例》还规定，捐献人的死亡应当由至少两名具有资质的临床医师按照医学规范作出书面判定。遗体接受单位和从事器官获取、移植的医务人员，不得参与死亡判定工作。未经省红十字会或者省卫生主管部门认定，擅自接受遗体、器官的，对单位处以二十万元以上三十万元以下罚款，同时撤销该机构接受遗体的资质或者从事器官移植诊疗科目登记，医务人员吊销其执业证书。(李竟成)
