　　法院依法审理查明，2012年6月28日晚，被告人方敦军邀约以前的学生吴某某（女）、向某某（女）、田泽明、骆某、庞某某在一烧烤店喝酒吃夜宵。骆某、向某某先后醉酒，方敦军到巫山县骡坪场镇君蓝宾馆开了三个房间，安排骆某在其中房间休息，安排向某某在另一个房间休息。之后，方敦军与吴某某、田某某、庞某某继续喝酒，不一会儿吴某某亦醉酒。方敦军独自将吴某某搀扶到宾馆自己开好的房间躺下，并下楼让田某某、庞某某到骆某的房间睡觉。随后，方敦军来到吴某某的房间，在吴某某醉酒后无能力反抗的情况下，与吴某某发生了性关系。后方敦军将吴某某抱到向某某的房间，自己又回到自己的房间休息。2012年6月29日22时许，公安民警在巫山县骡坪中学将方敦军抓获。
