　　“贩卖病死猪、注水猪非常猖獗，但屡禁不止。究其原因，法律标准过低致贩卖病死猪、注水猪在绝大多数情况下构不成犯罪，检察院都不予受理。”全国人大代表、保定市副市长闫立英说。

　　“我们很多次行动，都有公安介入，人赃俱获，还都有检验报告。但是交到检察院要起诉时，检察院说我们没法起诉，有的是因为案值不够，有的是因为没有造成严重后果，就是说没有吃死人。检察院不接，就打回公安局，公安局就交回食品监管部门，说你们处罚得了。”闫立英说。

　　全国人大代表、廊坊市政协副主席王学求建议，食品安全案件的立案不能按价格衡量，只要制假售假就应严格处置，“毕竟一头病死猪被贩卖到市场上，就有可能伤害很多群众的健康，这一块的执法和立法必须严苛和科学。”
