据赵女士介绍,2010年11月的一天,上小学三年级的元元回家说自己被同学打,语文老师兼班主任张玉(化名)不但没有帮他,反而把他拽到办公室罚站两节课。为了解情况,赵女士在元元身上装了一个MP3,录音内容让她大吃一惊。

赵女士说,张玉还经常用一些侮辱人格的话辱骂学生,比如最坏、品质低劣、动物、缺德、疯子等等。

赵女士说,从6岁到8岁,元元一直在张玉的班里学习。元元学习成绩本来非常优秀,多次在班里考第一名,但张玉多次对元元进行无休止的惩罚、谩骂、羞辱和情绪虐待,让孩子变得异常紧张、恐惧和暴躁,甚至想自杀。医生确诊结果为“儿童情绪障碍”。

去年8月,赵女士代替元元,将北京市育才学校通州分校和张玉一并诉至法院。赵女士一共提出7项诉讼请求:要求口头、书面赔礼道歉;赔偿治疗费、精神损失费等合计17万余元。同年9月20日,通州法院正式立案。

赵女士的代理人、北京市陈志华律师事务所律师刘巍表示,多项法规均规定教师应当尊重学生的人格,不得歧视学生,不得对学生实施体罚、变相体罚或者其他侮辱人格尊严的行为。上诉人在原审中提交的录音证据,已经证明教师张玉对学生元元存在经常性的体罚、变相体罚行为及严重的辱骂、讽刺、威吓等侮辱人格的行为,并非仅仅为“语气不当,情绪急躁”。法院“未能确定鉴定机构”后,未进一步采取补救措施,继续委托可以进行此项鉴定的机构进行鉴定,却以“摇号未能确定鉴定机构”为由,认定上诉人承担举证不能的责任,实质上剥夺了上诉人的举证权利。
