含辛茹苦把养女抚育成人，念大学，去新加坡，不料却遭养女骂，还被断绝一切来往，伤透了心的张老伯夫妇近日将养女诉至海淀法院，要求解除收养关系。记者昨日获悉，老两口的诉讼请求获得了法院支持。在庭后一些市民为老夫妇“不值”，“应该要求养女支付赡养费”，还有的甚至提出“应让养女返还抚养费”。

　　作为原告的张老伯和王老太老夫妇称，1979年他们收养了张老伯弟弟的女儿小张，时年11岁，户口也由武汉迁入北京。养女小张在北京念了小学、中学、大学，后来去了新加坡。

　　老两口认为，养女这样对待含辛茹苦抚养她的养父母，给他们造成了很大的伤害。“我们的精神压力太大了。因此，我们请求法院判令解除我们与小张的收养关系。”

　　庭后，法官王克鸽、胡光说，根据我国《收养法》第27条规定，养父母与成年养子女关系恶化、无法共同生活的，可以协议解除收养关系。根据庭审查明的事实，以及张老伯和王老太提交的证据，可以认定小张与二人关系恶化，且已经多年未在一起共同生活；小张成年后在对待张老伯、王老太问题上，存在不足之处，而且张老伯、王老太坚持要求解除收养关系，法院对此予以准许。

　　对于有人提出的“养父母可否要求不孝养子返还抚育费”的问题，法官认为，提供养子女的读书费、生活费等抚育费用相当于“赠与”，包括大学读书的学费等都应该属“赠与”，按照相关规定，如果主张返还一般是不予支持的。除非有证据证明给18岁以上的成年养子女的一些费用是“借款”，否则将很难获得支持。
