　　陈里分析认为，1、长期形成和执行的“地方负责，分级管理”的义务教育体制，致使地方政府职责不明确，管理不到位，办学经费不落实； 2、现行户籍制度与人口流动需求不相适应、不够协调，导致了农民工子女就地接受教育需要支付高昂的借读费和赞助费； 3、教育公平发生偏差，部分学校和教师歧视农民工子女学生，非法无情地剥夺了农民工子女学生与城市学生同等的一些受教育权利。如农民工子女学生不能参加学校或当地各级政府举办的各种活动，不能参加“三好学生”评选，甚至不能参加体育比赛等等；4、农民工子女学校办学条件差、师资弱、流动性大，办学合法化问题很难解决。有的地方甚至百般阻挠农民工子女学校的兴办，或武断地加以取消。
