本报讯（记者裴晓兰）中学生小利上体育课时投掷标枪，击中了同学小文的头部，致其十级伤残。记者昨天获悉，顺义法院一审判决小文获赔3万余元。

　　法院认为，中学将标枪作为篮球运动的标杆，体育设备存在明显不安全因素，老师指示学生取体育器材而不在场监督，亦存在管理疏忽，故中学应承担赔偿责任。小利作为限制民事行为能力人，对自己的行为及后果应有一定的认知和预见能力，其投掷标枪直接导致小文受伤，小利的监护人应当承担责任。综合案情，法院判决中学赔偿小文2万余元，小利的监护人赔偿1万余元。
