　　南方日报讯 （记者/郭文君 通讯员/卓志明 袁瑞婷）一未成年人因一时贪念起而行窃，因犯罪情节较轻，东莞市第三市区人民检察院依据新刑事诉讼法，首次启动未成年人诉讼特别程序，对刚满16周岁的小军（化名）作出相对不起诉决定，为其提供改过自新、尽早回归社会的机会。

　　本案是新刑事诉讼法实施以来，该院首次启用未成年人刑事案件诉讼程序。出于对未成年人利益的保护，受案后该院立即指派了熟悉未成年人身心特点、具有同类案件办理经验的检察官专门办理该案。

　　鉴于小军犯罪时年仅16周岁，且犯罪情节较轻，依法可以相对不起诉。为了对小军制定具有针对性的教育改造方案，帮助其悔过自新，承办检察官对其成长经历、犯罪原因、监护教育等情况展开全面调查，以科学评估其回归社会改造的可行性。得知小军成长于单亲家庭，在亲友心目中其品行端正、勤劳孝顺，且其母亲因疾病行动不便。后辍学外出务工，小军由于找工作不顺利而一时贪念起继而行窃，其在押期间确实能够积极改造、表现良好，确有悔罪表现。同时，被害人周某表示其没有遭受财物损失，且小军年幼，希望司法机关对其从轻处罚。通过综合评估，该院最终决定对小军作出相对不起诉处理，让其回归家庭、回归校园、回归社会自我改造。
