　　今年5月，呈贡区法院审理本案后认为，当时的村或乡才是学前班或者幼儿班的办学主体，是刘琼丽的用人单位，农村小学成为学前班或者幼儿班的代理或者指导、管理机构，其办学表象不能代替真正的办学主体。刘琼丽从1983年开始任新村幼儿班教师，虽1989年幼儿班与新村小学合并，但新村小学对幼儿班或者学前班进行的是业务指导和管理，其用人单位仍是原呈贡县大渔乡新村村委会，刘琼丽的待遇也是由村委会进行补助。法院认为，刘琼丽与大渔乡中心学校不存在无固定期限劳动合同的劳动关系，因此驳回刘琼丽的诉讼请求。
