　　因一起银行承兑汇票纠纷，浦发银行(600000,股吧)武汉分行前天将中冶赛迪上海钢铁贸易有限公司（以下简称中冶赛迪钢贸）和交通银行宝山支行告上了法庭。

　　产生纠纷的两张票据，其开票时间为去年5月3日。当时，中冶赛迪钢贸向交易对手采购一批钢材（总金额不明），以现金和银行承兑汇票作为支付手段。

　　在法庭上，浦发银行武汉分行人士认为，中冶赛迪钢贸作为出票人，已将汇票交付给交易对手，并无资格向法院申请银行承兑汇票公示催告。中冶赛迪钢贸向法庭虚构失票事实，恶意申请公示催告。因此，浦发方面请求法院撤销前述宣告票据无效的民事判决书。

　　荥阳利丰村镇银行方面的人士也认为，此案中中冶赛迪公司亲手将汇票交给了交易对手，已不是这张汇票的最后持有人。汇票并未被盗、遗失或灭失，且在社会上正常流通。因此，中冶赛迪钢贸向法院虚构了“遗失”这一事实。

　　交通银行宝山分行方面人士则表示，交行宝山支行在本案中并无过错，停止支付是依照上海宝山区法院发布生效的法律文书操作的。对于浦发方面提出的撤销之前的宣告票据无效（除权）判决，交行方面请求法院予以公正判决。

　　记者咨询了票据从业人员和相关法律人士，皆表示未听闻出票人在交付票据后向法院申请公示催告的案例。目前此案尚未宣判。
