　　“截至2012年5月31日，全省349.52万农村留守儿童中，0-14岁年龄段有286.1万人，农村儿童留守率(留守儿童占农村儿童总数百分率)为44.13%。”这次来参加省十二届人大一次会议的省人大代表、省妇联主席肖百灵带来了这样一组数据。面对庞大的农村留守儿童群体，肖百灵建议，出台《湖南省农村留守儿童监护暂行条例》（以下简称《监护条例》），维护农村留守儿童权益。

　　2012年3月至8月，省妇联联合湖南农业大学成立课题组，开展了覆盖全省“十县百村千户”的农村留守儿童关爱服务体系建设可行性调研。这次调研以0-17岁、父母一方或双方外出6个月以上的农村留守儿童为调查对象，通过调查分析，课题组认为农村留守儿童生活质量不高，可能产生心理问题，缺少监护人也容易出现安全问题。

　　因此，肖百灵认为，《监护条例》中首先应该强化父母是农村留守儿童法定监护人的法律责任。“监护人的监护职责不仅是指支付抚养和教育费用，还有探望、照顾孩子的生活、以良好品行对孩子进行管理和教育、保护被监护人的身体健康及合法权益等。”肖百灵强调，父母外出打工，虽然将孩子委托给亲属看管，自己也定期交付抚养教育费用，但长期不回家探望和履行其他义务，也属于履行监护职责不全面。肖百灵提出，《监护条例》应明确规定：“如果条件允许，父母必须将未成年子女带到自己的工作地居住和入学，让孩子在自己的身边成长；如果条件不允许，尽最大可能降低母亲‘出行率’；原则上禁止3岁以下幼儿的母亲长期（半年以上）外出。”

　　那么，对于3岁以上的留守儿童，如果父母双方均外出打工，谁来照顾他们的生活？肖百灵表示，可以通过建立有偿代理监护制度，填补监护空位。她提出，农村留守儿童的父母在外出务工之前可以找相互信任、适合的亲人或朋友，甚至学校老师作为留守儿童的委托监护人，并签订相关的监护协议并约定相关费用。“如果由于父母不慎选择了不合适的委托监护人，则应由其承担相应的法律责任”。

　　肖百灵还建议，在父母无法找到委托监护人的情况下，可由当地民政局或者妇联等机构签订监护委托协议。此外，学生在校期间，学校应多给予学生在学习、生活上的帮助，多进行心理上的交流和辅导，为农村留守儿童的健康成长营造良好的环境。她建议，《监护条例》应规定：“父母长期外出无法照顾未成年子女的，应该委托符合监护资格的监护人代理监护，双方签订委托协议，明确规定双方的权利和义务，以及违反协议应负的责任”；“农村全日制寄宿学校可以接受外出务工人员子女的委托监护申请，双方签订委托协议，明确规定双方的权利和义务，以及违反协议应负的责任。”
