  此外,建议进一步推进信托法制建设,制定有关的细则规范信托关系各方当事人权利义务,建立信托受托人尽职管理标准和对受托人、信托从业人员的行政、民事、刑事追究机制等,以及建立对股东、实际控制人、信托从业人员侵占、挪用信托财产的法律责任追究机制等。

  缺乏统一的监管政策和制度,制度的层次和效力不一,市场准入门槛不一,使得信托市场出现了一定程度的混乱局面和不正当竞争,加剧了信托经营风险。笔者建议:一是提升信托监管部门的层级,增加机构、人员,充实力量,健全信托监管组织体系。二是制定营业信托方面的法律法规,目前规范信托公司业务方面的制度均为银监会的部门规章,急需上升为行政法规甚至法律。三是依法界定信托机构和信托业务,规范各类财产管理或理财业务,统一监管政策,建立经营规范、市场管理公平、税收合理、信息披露健全、法制不断完善的信托市场,形成统一的信托市场运行规则和良好的业务竞争机制。■
