最近，中国信托业协会发布了2012年二季度末信托公司主要业务数据，其中，信托资产达到55382.2亿元。这一数据虽然较一季度末的53016.07亿元仅增长2366.13亿元，环比增4.46%，增速放缓，但这仍然是我国信托业的一次历史性突破，较2011年二季度末的37420.15亿元同比增48%。

　　缺乏统一的监管政策和制度，制度的层次和效力不一，市场准入门槛不一，使得信托市场出现了一定程度的混乱局面和不正当竞争，加剧了信托经营风险。笔者建议：一是提升信托监管部门的层级，增加机构、人员，充实力量，健全信托监管组织体系。二是制定营业信托方面的法律法规，目前规范信托公司业务方面的制度均为银监会的部门规章，急需上升为行政法规甚至法律。三是依法界定信托机构和信托业务，规范各类财产管理或理财业务，统一监管政策，建立经营规范、市场管理公平、税收合理、信息披露健全、法制不断完善的信托市场，形成统一的信托市场运行规则和良好的业务竞争机制。■
